General
The general terms and conditions apply to all services offered by Sapore Mediterraneo GbR © with its contractual partners (organizers). Legal relationships between the organizer and a third party do not affect the legal relationship between Sapore Mediterraneo GbR © and the organizer. The organizer’s terms and conditions only apply if this has been agreed in writing.
The contract is concluded as soon as catering, the restaurant, other rooms or other deliveries and services have been ordered and confirmed. This can also be verbally, by email, by fax, by telephone or in person.
If the organizer is not the customer himself or if the organizer engages a commercial agent or organizer, they are jointly and severally liable with the organizer for all obligations arising from the contract. If Sapore Mediterraneo GbR © is prevented from fulfilling its services due to force majeure or a strike, no liability for damages can be derived from this.
Sapore Mediterraneo GbR has business liability insurance. The organizer is already informed that he has to take care of this in the event of extended insurance cover.
When commissioned by Sapore Mediterraneo GbR, musicians’ and artists’ fees must be made available in advance by the organizer. Any GEMA fees incurred are generally borne by the organizer. He also has to ensure the appropriate registration.
Payment terms
All prices in commercial transactions are plus statutory VAT / in private transactions including statutory VAT.
Offers that relate to the restaurant are always inclusive of VAT. Invoices are payable without deductions within 10 days of receipt; invoices can also be received by fax or email.
The default occurs, without further notice of default, on the 11th day from receipt of the invoice. Sapore Mediterraneo GbR is then entitled to claim interest at the statutory rate. Sapore Mediterraneo GbR is entitled to demand advance payment in advance of an event; the same payment conditions apply as when issuing an invoice.
The organizer can only set off undisputed or legally established claims against claims of Sapore Mediterraneo GbR. If a grace period of 10 days with the threat of rejection expires without result, Sapore Mediterraneo GbR can withdraw from the contract.
In the event of justified withdrawal by Sapore Mediterraneo GbR, the organizer is not entitled to compensation. If the organizer withdraws earlier than three months before the event date, Sapore Mediterraneo GbR is entitled to charge 20% of the offer price.
If the organizer withdraws between the 12th and 4th week before the event date, Sapore Mediterraneo GbR is entitled to charge 35% of the lost turnover, and 70% of the turnover for any subsequent withdrawal. Sales are calculated using the formula: Offer price (food, drinks, if applicable, other) x number of people.
Saved expenses are thus reimbursed.Changes in the number of participants or VA timeThe organizer is obliged to inform Sapore Mediterraneo GbR of the number of participants (guaranteed) at the event at least 3 days before the date.
If he only shares the actual number of participants between 3 days and 24 hours before the event, there will be a rush surcharge of 10% on the offer presented. Changes made 24 hours before the start of the event or failure to communicate the guaranteed number of participants will result in Sapore Mediterraneo GbR providing the service in accordance with your offer.
Any disadvantages that the organizer may incur as a result of this will not be borne by Sapore Mediterraneo GbR.
If the number of participants differs by more than 10%, Sapore Mediterraneo GbR is entitled to re-set the agreed prices; for a deviation of 10 to 20% by 15% and beyond that by up to 20%. If the actual number of participants deviates from the (guaranteed) number of participants by more than 40%, Sapore Mediterraneo GbR is entitled to refuse the service.
Bringing food and drinks
The organizer refrains from bringing food and drinks to events. Exceptions require a written agreement. In such cases, a service fee or corkage fee will be charged.
Technical facilities
The organizer provides Sapore Mediterraneo GbR with the necessary technical facilities free of charge for off-site catering. If this does not happen up to 6 hours before the event, Sapore Mediterraneo GbR is entitled to have the necessary technical equipment created.
The organizer undertakes to pay the invoiced costs plus an additional cost share of 25% to Sapore Mediterraneo GbR. If the organizer does not provide any technical facilities, Sapore Mediterraneo GbR is entitled to cancel the event until it begins; in this case, the organizer undertakes to pay 70% of the food and beverage sales (according to the food sales formula mentioned above).
The organizer releases Sapore Mediterraneo GbR from third-party claims to the extent that Sapore Mediterraneo GbR has not acted with gross negligence or intent. The organizer is obliged to inform Sapore Mediterraneo GbR in writing of any danger-increasing moments (also with regard to the rooms provided).
The organizer is responsible for any loss or damage to items brought in by the organizer, his representatives and his guests. Loss or damage caused by Sapore Mediterraneo GbR will be compensated upon proof in the event of intent or gross negligence. There are no further claims against Sapore Mediterraneo GbR.
The introduction of decorative materials and other equipment must be agreed upon in writing between the parties. The organizer Sapore Mediterraneo GbR must provide any necessary official approvals up to 48 hours before the event.
If he fails to do this, Sapore Mediterraneo GbR is entitled to terminate the contract and demand 70% of the food and beverage sales in accordance with the food sales formula. If the necessary approval is to be obtained from Sapore Mediterraneo GbR, the organizer will pay a flat rate of € 50.00 plus the fees.
Non-identity between the organizer and the client. The sole contractual partner of Sapore Mediterraneo GbR is the organizer. Sapore Mediterraneo GbR does not make any further contractual agreements with third parties; this is the responsibility of the organizer.
Sapore Mediterraneo GbR is entitled to withdraw from the contract until the start of the event if the organizer does not make such a declaration. In the event of withdrawal from the contract, Sapore Mediterraneo GbR is entitled to demand 70% of the food and beverage sales in accordance with the food sales formula.
We reserve the right to correct errors as well as printing and calculation errors.
